LOS ANGELES -- It wasn't two left feet, but two fractured feet that forced Tom DeLay to hang up his dancing shoes on Tuesday. The former House Republican Whip said he's taking his doctor's advice and leaving the ABC television show "Dancing With the Stars."

DeLay has been diagnosed with stress fractures in both feet from the rigors of dancing and must wear foot braces when away from the ballroom.

Doctors and producers urged the 62-year-old to fake rolex withdraw from the dance-off. But he was determined to continue Monday, performing a sufficient samba with professional partner Cheryl Burke.

"What's a little pain when you can party?" he asked before performing.

But the pain proved too much Tuesday and DeLay said he couldn't continue on the hit reality show.

"If you can't practice, you make a fool of yourself out here," he said. "And I don't want to do that to Cheryl."

The former Texas congressman said his next dance would have been the Texas two-step. Show host Tom Bergeron invited DeLay to perform the dance on the season finale if his feet were up to it.

"That'd be wonderful," said DeLay, still wearing his red-and- white performance outfit adorned with a Republican elephant.

DeLay and Burke finished one point away from last place Monday, earning 15 points out of 30.

Chris Rock faces suit over 'Good Hair'

LOS ANGELES -- A filmmaker is suing Chris Rock for at least $5 million and trying to block the release of his upcoming documentary "Good Hair."

Regina Kimbell sued Rock and several film companies in federal court in Los Angeles earlier this week, claiming Rock's project is a copycat of her film, "My Nappy Roots."

Kimbell states she screened her film for the comedian in 2007. The lawsuit states "My Nappy Roots" traces the business and cultural history of black hair care and has otherwise only been shown at colleges and film festivals since its completion in 2006.

Her lawsuit claims several of elements of her film have been copied.

Rock's publicist declined to comment.

"Good Hair" will be released in certain cities Friday and nationwide Oct. 23.

Gibson gets conviction expunged from record

LOS ANGELES -- A judge has ruled that Mel Gibson's conviction stemming from his notorious 2006 drunken driving arrest is being expunged.

The ruling Tuesday came after his lawyer had requested the dismissal. The actor-director successfully completed the terms of his three-year probation following the misdemeanor drunken driving arrest, in which he made derogatory comments about Jews and women.

As part of his no-contest plea, Gibson was sentenced to three years of probation, paid about $1,600 in fines and had to attend Alcoholics Anonymous and other meetings.

Gibson has repeatedly apologized for making the derogatory comments about Jews to the sheriff's deputy who arrested him in 2006 in Malibu, Calif.
